Terms of Service.

By accessing or using the JNC Funding website (the "Site") or our SMS/text messaging program, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Site or the messaging program.

The Site and our services are directed to real estate investors and businesses. You represent that you are at least 18 years old and legally able to enter into these Terms.

Information on the Site is for informational purposes only and does not constitute a commitment to lend or an offer to extend credit. All financing is subject to underwriting, credit review, property qualification, and final documentation. Rates, leverage, and program features may change without notice.

JNC Funding operates an application-to-person (A2P) 10DLC messaging program. By providing your mobile phone number and opting in (via web form, verbal consent, written consent, or by initiating a text conversation with us), you agree to receive SMS/MMS messages from JNC Funding.

• Program name: JNC Funding.
• Message types: transactional messages about your inquiry, application, deal status, closing coordination, servicing, and — only when you separately opt in — marketing and promotional messages.
• Message frequency: varies; messages are sent as needed based on your interaction with us.
• Cost: Message and data rates may apply. Contact your wireless carrier for details of your plan.
• Help: Reply HELP to any message for assistance, or email deals@jncfunding.com.
• Opt out: Reply STOP to any message to unsubscribe. You will receive a final confirmation and no further messages. To re-subscribe, opt in again.
• Carriers: Supported on major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
• Consent is optional: Consent to receive SMS is not a condition of any purchase, application, or financing.
• No sharing: Your mobile number, SMS opt-in information, and consent records are not shared with third parties or affiliates for marketing purposes. Data is shared only with service providers (e.g., our messaging platform and carriers) as needed to deliver the messages, or as required by law. See our Privacy Policy.

You agree not to:

• Use the Site or messaging program for any unlawful purpose or to harass others.
• Attempt to gain unauthorized access to any portion of the Site or its systems.
• Submit false, misleading, or fraudulent information, including phone numbers you are not authorized to enroll.
• Interfere with the operation of the Site, including through scraping, automated tools, or denial-of-service activity.

The Site, including its content, logos, and trademarks, is owned by JNC Funding or its licensors and is protected by intellectual property laws. You may not copy, modify, or distribute Site content without prior written permission, except as permitted by law.

The Site may link to third-party websites or services. We are not responsible for their content, policies, or practices. Access them at your own risk.

THE SITE AND MESSAGING PROGRAM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JNC FUNDING AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR THE MESSAGING PROGRAM.

You agree to indemnify and hold harmless JNC Funding, its affiliates, and their respective officers, directors, employees, and agents from any claim or demand arising out of your breach of these Terms or misuse of the Site or messaging program.

These Terms are governed by the laws of the state in which JNC Funding is organized, without regard to conflict-of-laws principles. Venue for any dispute shall lie in the state or federal courts located in that state, and you consent to personal jurisdiction there.

We may update these Terms from time to time. Material changes will be indicated by updating the effective date above. Your continued use of the Site or messaging program after changes take effect constitutes acceptance of the revised Terms.
